Terms of Service — Attendify


These Terms of Service (“Terms”) govern your access to and use of Attendify, a face-recognition based attendance and visitor management platform operated by Techkshetra Info Solutions Pvt Ltd,.(“we”, “our”, or “us”) in India.

By accessing or using www.attendify.ai or our Services, you agree to these Terms. If you do not agree, you must stop using the platform.

1. About Attendify

Attendify is a workplace automation platform used for:

  • face recognition attendance
  • employee & visitor identity verification
  • automated check-ins & access management
  • shift tracking, logs, and reporting
  • workforce attendance analytics

The platform is provided to organizations and employers for internal operational use.

Each organization using Attendify is responsible for:

  • obtaining valid and informed consent from users (where applicable)
  • displaying biometric usage notices at premises
  • providing lawful purpose for data processing
  • complying with applicable labour & data protection laws
2. Eligibility & Authorized Use

By using the platform, you confirm that:

  • you are an employee, administrator, or authorized user of an organization using Attendify
  • the information you provide is accurate and lawful
  • you will comply with these Terms and applicable Indian laws

Unauthorized access or misuse of the platform is prohibited.

3. Accounts & Access

Certain features require account creation or administrator access.

Users are responsible for:

  • safeguarding login credentials
  • ensuring accuracy of submitted data
  • notifying the organization or support team in case of unauthorized access
4. Processing of Biometric & Attendance Data

Attendify may process, where enabled by your organization:

  • facial recognition templates
  • attendance timestamps & logs
  • check-in / check-out verification metadata
  • device & terminal activity logs
  • visitor verification details

Biometric data is processed strictly for:

  • identity verification
  • attendance automation
  • workplace access & security

Attendify does not use biometric data for:

  • marketing or profiling
  • unrelated analytics
  • sale or commercial transfer to third parties

The organization, not Attendify, is the primary data fiduciary for employee records under the DPDP Act.

5. Acceptable Use Policy

You agree not to:

  • interfere with system security or performance
  • attempt to extract, reverse engineer, or copy system code
  • upload false, harmful, or misleading information
  • misuse biometric verification features
  • access accounts or data without authorization

We may restrict or terminate access in case of policy violations.

6. Subscription, Fees & Billing (If Applicable)

Where subscription plans apply:

  • fees are defined in proposals or pricing plans
  • payments are processed via secure payment gateways
  • subscriptions may auto-renew unless cancelled
  • fees are non-refundable unless otherwise stated in writing

Pricing revisions, if any, will be notified in advance where applicable..

7. Intellectual Property

All platform technology, designs, content, and trademarks are owned by Techkshetra Info Solutions Pvt Ltd,. or its licensors.

Users may not:

  • copy, modify, or distribute platform components
  • resell or sublicense access to the software
  • use branding without permission

Limited internal organizational use is permitted.

8. Third-Party Integrations

Attendify may integrate with HRMS, payroll, IoT devices, and access control systems.

We are not responsible for:

  • functionality or accuracy of third-party systems
  • their privacy or security practices

Use of integrations is at the organization’s discretion.

9. Disclaimer of Warranties

The Services are provided on an “as-is” and “as-available” basis.

We do not guarantee:

  • uninterrupted or error-free operation
  • real-time or always-accurate logs
  • perpetual availability of integrations

Use of the platform is at your discretion.

10. Limitation of Liability

To the maximum extent permitted under Indian law, Techkshetra Info Solutions Pvt Ltd is not liable for:.

We do not guarantee:

  • indirect, incidental, or consequential damages
  • payroll, HR, or attendance disputes
  • loss of business, revenue, or data
  • misuse of biometric or attendance data by organizations

Our aggregate liability will not exceed the amount paid for use of the Services (if applicable).

11. Termination

We may suspend or terminate access where:

  • Terms are violated
  • unlawful activity is suspected
  • platform misuse is detected

Organizations may also request user removal.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India, and subject to the jurisdiction of courts at Bangalore.
